BRITA ARENA STADIUM REGULATIONS

Visitors entering the stadium as well as all contract users who have reached a licencing agreement with the stadium operator give their consent to the validity of the stadium regulations of the BRITA Arena set out below. The aforementioned contractual users undertake to provide all employees and other persons who gain access to the stadium as part of the execution of the contract with information regarding these Stadium Regulations and their validity. In the case of league matches, the organiser is SV Wehen 1926 Wiesbaden GmbH; in the case of other events, the respective tenant of the stadium is the organiser of the event in question. The operator of the BRITA Arena is Stadion Berliner Straße GmbH & Co. KG (operator), Berliner Straße 9, 65189 Wiesbaden.

 

1.    Area of application

1.1.    The area of application of these stadium regulations applies to the entire grounds of the BRITA Arena (including access and exit routes as well as parking areas).

1.2 These Stadium Regulations shall be observed by all persons entering the area of application (hereinafter referred to as the "stadium") at all times.

 

2.    Purpose

2.1 The stadium’s chief purpose is to provide a venue for football matches and major events of supra-regional or ceremonial significance. In addition, non-sporting events can take place in the functions building.

2.2.    The Stadium Regulations apply to all events that take place within the stadium grounds.

2.3.   The general public is not entitled to use of the stadium and the meeting rooms contained within.

2.4.    Individual contracts for the use of the stadium are subject to civil law. The stadium operator serves as the point of contact in these cases.

 

3.    Instructions and video surveillance

3.1.    All instructions given by the operator as well as other persons authorised to exercise the householder's rights (e.g. event organisers) as well as the security services used in connection therewith (control, security and order services as well as employees of the police and other order authorities) are to be observed at all times in the stadium. 

3.2. For reasons of security and risk prevention, the BRITA Arena, the parking spaces made available and the access and exit routes are all under video surveillance.

3.3 Every visitor to an event at the stadium agrees that the organiser is entitled, within the framework of the event and without being obliged to pay any compensation, to create and/or have created by third parties video and sound recordings of the visitors, to reproduce, broadcast and use these in any audiovisual media and/or have them reproduced, broadcast and used by third parties.

 

4.    Authorised persons

4.1.    Only persons in possession of a valid admission ticket or who can prove their entitlement to admission in another way (e.g. by means of a valid authorisation card) are permitted to access the area covered by these stadium regulations. This applies in particular to access to the boxes and business seats.

4.2.    Children up to the age of 14 must be accompanied by an adult. Children up to the age of 14 are not permitted to enter certain "supporter" areas.

4.3.    Persons who have been banned from the stadium by the operator or organiser and/or by a court decision do not have any right of access to the stadium.

 

5.    Entrance controls

5.1.    Upon entering the stadium, every person must present his/her admission ticket or other proof of entitlement to inspection to the control, security and order service as well as police and other order officials without being requested to do so and to hand it over for inspection upon request. After passing through the entrance areas, admission tickets are non-transferable. During the stay in the stadium, the duty to show and hand over tickets shall apply if requested to do so by the control, security and/or order service or by police or other order officials. A justification of this request is not necessary. Admission tickets entitle the holder to attend only those events for which they have been purchased. Admission is only permitted within the buildings, parts of buildings or access areas designated by the admission ticket or other proof of entitlement during opening hours. After leaving the stadium and at the end of the respective event, the ticket loses its validity. Any misuse of tickets will result in their immediate forfeiture as well as immediate removal from the stadium and legal action. Black market trading will be reported without exception. In all other respects, the general ticket terms and conditions of the respective event organiser shall apply.

5.2.    Persons who, on the basis of their behaviour or other indications or findings, are suspected to...

have been issued with a local or national stadium ban preventing the attendance of sports events or other events, or

be in possession of any objects (e.g. pyrotechnic articles) that are prohibited by the stadium regulations, or

represent a threat to safety and order within the stadium,

may be subject to a search carried out by either on-site security personnel or the police and other law enforcement officials, who are entitled to search items of clothing and containers carried, to seize prohibited items, to make judgements regarding the possible influence of alcohol and/or drugs and/or - in particular in the event of a possible stadium ban - to verify the identity of the suspected person through the inspection of identity documents, using technology to clarify the situation if required.

Those who do not give their consent to a search of their person will either be excluded from entering the stadium, or, if already in the stadium, removed from the premises by either the on-site security personnel or the police and other law enforcement officials.

5.3.    Visitors who...

...are visibly under the influence of drugs

...are in possession of weapons or other dangerous objects and do not consent to their seizure by the on-site security personnel or the police and other law enforcement officials or

...are visibly under the influence of alcohol or

...are suspected to be carrying an infectious disease as defined by the Federal Law on Infectious Diseases or the Infection Protection Act or show signs of infestation with pests

will be expelled from the stadium grounds..

5.4.    Away fans dressed in the club colours of the away team or fans dressed in club colours other than those of SV Wehen Wiesbaden are not permitted to enter the home section in the North Stand.

 

6.    Use of the Stadium

6.1.    The stadium may only be used within the framework of activities resulting from contractual arrangements agreed upon by organisers, tenants and other users. The use of the stadium is limited to the number of persons specified in the respective contract. If this number of persons is exceeded - especially at events - the operator or owner of the house rights or the personnel deployed by the operator or owner of the house rights (security personnel, police officers or other law enforcement authorities) are entitled to deny entry to the surplus persons. It is forbidden to enter the playing field or climb on barriers.

6.2.    Within the stadium, everyone must behave in such a way that no one else is harmed, endangered or - more than is unavoidable under the circumstances - obstructed or bothered.

6.3.    Parking of vehicles and parking of bicycles or other means of transport is only permitted with a valid parking permit and only in the designated spaces. All entrances and exits as well as escape routes must be kept clear of obstructions at all times.

6.4.    At events, visitors may only occupy the space allocated to them and only use the designated entrances to arrive at the allocated space.

6.5.    For reasons of safety and risk prevention, visitors are obliged, on the instructions of the operator or organiser or the on-site security personnel, police officers or other law enforcement officials, to relocate to places other than those stated on the entry ticket – even if these places are located in other blocks.

6.6.    Due to the structure of the stadium, visibility is impaired in some places. These seats are displayed in the seating area. In the standing area, flags or the like can obstruct visibility, especially in the "supporter" area.

 

7.    Opening times

The opening times of the stadium are set by the operator or the organiser of an event being held in the stadium.

 

8.    Changing rooms, showers, offices and secondary rooms

8.1.    Access to and use of the changing rooms, shower rooms, offices and other secondary rooms is only permitted by contractual agreement with the operator of the facility during the contractually agreed times for the persons specified in the contract. All functions rooms and their facilities (changing rooms, etc.) are to be used in accordance with their intended purpose.

8.2.    The changing rooms must remain closed at all times.

 

9.    Cleanliness

All users of the stadium are obliged to treat all stadium facilities and equipment with care and to leave them in a clean condition. Damage must be reported to the operator immediately. In particular, no waste, ash, harmful liquids or the like may be poured or thrown in sinks, sinks or toilets. Waste must be disposed of in the appropriate containers or waste receptacles.
 

10.    Advertising and decoration

Advertising or propaganda measures of any kind as well as the attachment of decorations and other objects are generally prohibited in the stadium unless they...

...are permissible on the basis of written contractual agreements between the operator and the users and there is an obligation within the framework of these agreements to restore the original condition after termination of the contract or

...have been authorised in a specific case as indicated by the operator in writing..

The distribution of flyers, leaflets and magazines in the facility and on the rest of the site is permitted only with the permission of the organiser and/or the operator, unless other official regulations stipulate otherwise.

 

11.    Retail/hospitality

11.1.    The sale of goods of all kinds, the distribution of printed material, the holding of collections and the installation of fittings, stalls, stands or similar is prohibited in the stadium and the area allocated to the event unless carried out within the framework of a contractual entitlement of the respective user/organiser and the requisite legal permits have been obtained.

11.2.    The catering service offered to users and other visitors can only be that of the caterer/service provider appointed by the operator for the stadium.

 

12.    Liability

12.1.    The liability of the operator and/or organiser, its legal representatives and vicarious agents for damages resulting from injury to life, body or health, or liability under the product liability law is not limited by these Stadium Regulations.

12.2.    The liability of the operator and/or organiser, its legal representatives and vicarious agents for other damages not mentioned in section 12.1 is excluded, unless the damages result from...

...an intentional or grossly negligent breach of duty, or

...circumstances of a culpable breach of essential contractual obligations (cardinal obligations).

12.3.    Any accidents or damage must be reported immediately.

 

13.    Electronic devices and machinery

Electronic devices brought into the stadium may only be used if doing so does not affect the rights of the operator or the respective holder of the house rights as well as the overall operation of the BRITA Arena. Machines may only be used with the written agreement of the operator.

 

14.    Parking spaces

Lawns, corridors and other circulation areas may not be used for parking purposes unless there is a contractual entitlement to do so.

 

15.    Prohibited items 

15.1.    Persons within the area of application of these Stadium Regulations are forbidden from having the following items on their person:

Weapons or other dangerous objects as well as objects which, if thrown, may cause bodily injury to persons; this also applies in particular to umbrellas (non-collapsible umbrellas); fully collapsible umbrellas are permitted;

Gas spray bottles, corrosive or colouring substances or pressure vessels for highly flammable or health-damaging gases, with the exception of commercially available pocket lighters;

Bottles (including PET bottles), cups, jugs, cans or other containers made of fragile, splintering or hard material; non-alcoholic beverages up to 0.5 litres in volume are permitted;

bulky items such as ladders, stools, chairs, crates, suitcases, prams, bicycles

Fireworks, rockets, flares, smoke powder and other pyrotechnic items;

Flag or transparent poles which are longer than 1.50 metres or have a diameter greater than 3 m (see Hazard Prevention Ordinance). Flags or transparent poles which are longer than 1.50 metres may only be brought into the BRITA Arena with a flag permit.;

large banners, larger quantities of paper, rolls of wallpaper;

mechanical and electrically operated noise-producing instruments - the operator reserves the right to make exceptions;

all types of alcoholic beverages and drugs;

animals;

Material which is racist, xenophobic, discriminatory and promotes violence and far-right and/or far-left political causes; the same applies to clothing which bears lettering or symbols which is racist, xenophobic, discriminatory and promotes violence and far-right and/or far-left political causes (this rule applies even if the material in question is not prosecutable in law);

Articles intended to prevent the identification of an individual;

Whistles;

Laser pointers;

Styrofoam blocks;

Air horns;

All types of SLR cameras, all cameras with interchangeable lenses, as well as medium and large format cameras. Also not permitted are all video cameras for recording moving images (film cameras); mobile phones with camera function and compact cameras are permitted provided they are not equipped with an interchangeable lens;

The organiser and the security services (on-site security personnel, police officers or other law enforcement officials) reserve the right to prohibit the introduction into the stadium of other dangerous or bulky objects which could be used as projectiles, regardless of whether or not the items in question are explicitly prohibited in the Stadium Regulations.

15.2.    Persons within the area of application of these Stadium Regulations are not permitted...

to enter the interior, pitch or function rooms of the BRITA Arena without permission to do so;

to enter, climb or step over buildings and equipment not intended for general use, in particular facades, fences, walls, lawn enclosures, barriers, stages, lighting installations, camera platforms, trees, masts of any kind or roofs;

to sit, lie or, without there being any recognisable need to do so, stand in the way of entrances and exits to and from the stadium as well as rescue and escape routes or stairway platforms;

to enter areas marked as not accessible to visitors;

to constrict circulation areas, in particular footpaths and driveways;

to throw objects;

to label, paint or put stickers on structural installations, facilities or paths;

to set off fires, burn or fire pyrotechnics of any kind, in particular fireworks, flares, magnesium torches, smoke candles and pyrotechnic object

to support or instigate such actions, for example by acting as a lookout. 

to carry out preparatory actions for the burning of pyrotechnic articles or to support, instigate or aid such actions;

to urinate or defecate outside the toilets;

to make film, photo, tape and/or video recordings in connection with events without the corresponding copyright permits. Ticket holders are not permitted to record sound, images, descriptions or results of the event (except for private purposes) or to transmit or distribute them in whole or in part via the Internet or other media (including mobile telephones) or to assist other persons in such activities without the prior consent of the event organiser. Devices or equipment that may be used for such activities may not be brought into the facility without the prior consent of the organiser. Photos and images created by ticket holders during a game may only be used for private purposes. Any commercial use, no matter in which way and by whom, requires the prior written consent of the organiser or operator.

 

16.    Violation

16.1.    Persons who violate the the stadium regulations may be denied access to the stadium without compensation and/or may be expelled from the stadium. The further rights of the operator or the organiser shall remain unaffected. Persons whose behaviour inside or outside the stadium in connection with an event affects or endangers the safety and order of the event in question may be banned from entering the stadium without any compensation. The further rights of the operator or the organiser shall remain unaffected. This stadium ban may be restricted to the stadium or imposed nationwide in accordance with the principle of proportionality.

16.2.   If damage is caused by actions as defined in section 15 of these Stadium Regulations or by other culpable acts of damage, the perpetrators - insofar as no contractual regulations apply - shall be held liable for damages within the framework of the statutory provisions. In addition, the operator reserves the right to impose a separate contractual penalty.

16.3.    If it is suspected that a person within the area of application of these stadium regulations has committed a criminal act or a misdemeanour, a charge will be filed.

16.4.    Objects prohibited from being carried shall be seized by the on-site security personnel, police officers or other law enforcement officials, kept in the designated depots - insofar as this is possible and reasonable - and, insofar as they are not required as evidence for criminal investigation proceedings, returned upon request after the preconditions for seizure or detention have ceased to apply. If the objects taken into custody are not collected two weeks after the event, it is assumed that the owner has given up possession of the objects with the intention of renouncing ownership.

16.5.    Measures outlined in paragraphs (1) to (4) exclude claims (e.g. reimbursement of entrance fees) against the operator and/or against the respective organiser.

 

17.    Stadium access

17.1.    Driving any type of vehicle is prohibited in the stadium.

17.2.    For events, traffic on the routes that are used concurrently for spectator access is only permitted for loading and unloading and must be completed no later than one hour before the start of the event (or - if admission takes place earlier - no later than the point at which spectators enter the event). Police, ambulance and fire-fighting vehicles on duty or on standby are excluded from this.

17.3.    Associations, facilities, institutions, users, etc. are only granted entry permits in instances in which access to the stadium has been proven to be absolutely necessary. Entry permits can only be granted through an application to the operator of the stadium. The entry permit must be presented unsolicited at the entrance and clearly displayed in the parked vehicle.

17.4.    The maximum speed limit in the stadium grounds is set at 20 km/h.

17.5.    Driving on sports pitch and lawn areas is prohibited, unless there is special permission to do so under contractual agreement or in case of an imminent hazard..

17.6.    Parking is only permitted in the parking lots and only in the designated and signposted or allocated parking areas (marking).

17.7.    Parked vehicles in fire brigade/emergency access roads, on sports pitches or lawn areas as well as vehicles without parking or parking authorisation visible from the outside will be towed away or moved at the owner's expense

17.8.    Driving motorcycles in the stadium grounds is prohibited.

17.9.    It is not permitted to park or chain bicycles on the stadium fence. Unlawfully parked bicycles will be moved at the owner's expense.

17.10.    The operator reserves the right to impose special regulations.

17.11.    Violations of the above provisions will result in the withdrawal of the entry permit. In the event of a repeat offence, the driver or owner of the vehicle will be banned or reported to the police.

 

18.    Use of parking lots

All parking areas are subject to the regulations of the Road Traffic Regulations (StVO) in place. Use of the parking and parking spaces is at the user's own risk. Driving must be done at walking speed in all parking areas. The operator or the respective organiser shall not be liable for personal injury, property damage or financial loss, in particular in the event of damage, burglary or theft of the motor vehicle as well as for damage resulting from the relocation or towing of an unauthorised and/or incorrectly parked vehicle. Claims for damages between users or against third parties shall be governed by the provisions of civil law. There is no obligation on the part of the operator or the respective organiser to ensure road safety. The operator or the respective organiser is not obliged to guard parked vehicles.

users undertake to comply with the rules listed below:

18.1.    Contamination by oil, petrol, battery acid or other substances must be removed. The costs for this shall be borne by the party responsible, unless otherwise stipulated in the written contracts with the respective tenants and other contractual users.

18.2.   Vehicle parking spaces must be used with the greatest possible consideration. Other users of the system should not be affected more than is unavoidable by the operation of the vehicle in question (engine noise, closing of doors, etc.).

18.3.    All parking and parking authorisations are valid only for the respective day of the event. At the latest 2 hours after the end of the event, the vehicles/motorcycles/bicycles must be removed from the parking areas and from the stadium grounds. In the event of non-compliance with this, the parked or parked vehicles/motorcycles/bicycles will be towed away or moved at the owner's expense.

18.4.    Only registered, operational and registered passenger vehicles or motorcycles (incl. scooters and mopeds) may be parked. Trucks, boats, trailers etc. may not be parked.

18.5.    It is strictly prohibited to set an open fire or light on the parking and parking areas; to store, drain, refill or fill flammable, combustible or environmentally harmful objects/substances such as petrol, oil, acids, paints, batteries, used tyres, emptied fuel containers etc.;

Pour substances as described above into the drainage system;

to keep the engine of the vehicle running longer than necessary for starting or parking the vehicle;

Close ventilation systems;

to park vehicles which dispose of polluting substances such as oil or fuel;

carry out repairs or maintenance work;

wash vehicles;

to stay overnight or camp in vehicles.

 

19.    Special provisions applicable to football matches. 

19.1.    In the case of Bundesliga matches, the DFB guidelines on the improvement of security at Bundesliga matches and the DFB Committee for Security guidelines on the uniform application of stadium bans (subject to amendments) also apply.

19.2.    Section 4.3 shall apply in the same way if the ban has been issued by the DFB, a DFB club, UEFA or FIFA.

 

20.    Special provisions for rental and leasing contracts

20.1.    The operation of the floodlight system is only possible in accordance with contractual agreements and in special cases requires the express permission of the operator.

20.2.    The use of telecommunications hardware, lines, connection sockets etc. is only permitted after prior consultation with the operator, if necessary for a fee determined by the operator.

20.3.    The operator reserves the right to temporarily close the stadium for the execution of maintenance and repair work. Access to the stadium during these times is restricted.

20.4.    Decorations and other objects that are permitted to be brought in during events must be removed immediately after the end of the event. The hammering in of nails, hooks etc. as well as the gluing of floors, walls, ceilings during events is generally prohibited.

20.5.    The operator or its representatives may enter all areas of the stadium. This applies to the transfer of use to third parties after prior notification if nothing to the contrary has been agreed in writing in the contract. It must be ensured that the areas can be accessed even in the absence of contractual users. In case of longer absence (e.g. holidays, company holidays etc.) the keys are to be deposited.

 

21.       Final clause

21.1.    These Stadium Regulations came into effect on 01.07.2012.

21.2.   These Stadium Regulations can be altered by the operator at any time without need for justification. These stadium rules can be changed by the operator at any time and without giving reasons. Each new version of these Stadium Regulations automatically replaces any older version and thus renders it invalid.
