"Man of the Match" Conditions of Participation

1. Application

These conditions of participation are applicable to all participants in the draw made as part of the “Man of the Match” competition that is integrated into the website: www.svww.de. By participating in the competition, participants declare their consent to these conditions. 

The competition is organised by:

2. The Right to Participate

Persons aged 18 years or older may participate. While SVWW employees, employees of companies which were or are involved in the preparation and/or organisation of this competition and their relatives may take part in the competition, they may not participate in the prize draw. The participation of agencies of any kind and automated mass participation are explicitly forbidden.

3. Performance

Participants can take part in the competition during every match played by SV Wehen Wiesbaden’s senior team in the 2019/20 Bundesliga 2. season. They can take part immediately after the match has kicked off up until full-time is called. The time at which someone is deemed to have participated is the point at which he or she submits the required data.

In order to participate in the draw, participants need to access the website using a supported browser and must accept the cookie guidelines. Participants can select a player from the players fielded by SV Wehen Wiesbaden on the current matchday, enter their name or an assumed name and leave behind a mobile telephone number. After consenting to the conditions of participation, participants may cast their vote and, in doing so, participate in the competition.

Each person who is entitled to participate may only participate in the competition once per match and with only one mobile telephone number.

The draw from among the participants in the competition will take place immediately after the match and will be carried out automatically and according to the principle of randomness.

Participants are responsible themselves for the accuracy, completeness and usability of the data they have provided – false or inaccurate information will be to their disadvantage alone. SVWW accepts absolutely no liability in this regard. 

Participation in the competition is free of charge, notwithstanding the participant’s Internet costs and costs of transmission. The extent of these costs will depend on the tariff selected from the particular mobile telephony provider or Internet service provider. SVWW will not cover these costs. There will not be any open or hidden follow-up costs.

Participation in the competition will take place exclusively via the Internet.

4. The Draw & Prizes

After the match has ended, all participants will be entered into a draw to win the respective man of the match’s strip with his signature on it.

Payment of the prize, for example, in cash or in kind, its exchange or its transferral to other persons is not possible. The participant may waive his or her right to the prize.

5. Notification of a Win and Delivery of the Prize

The winner will be drawn immediately after the match, notified of this using the mobile telephone number provided by him or her and requested to provide his or her full name for the purpose of delivering the prize.

Where notification of a win cannot be delivered to the winning participant, SVWW is under no obligation to make further enquiries as to his or her contact details. In such circumstances, the participant’s entitlement to the prize will lapse and a new winner will be selected. The way in which the prize is to be delivered will be arranged on an individual basis with the winner.

6. Exclusion/Premature Ending

SVWW cannot guarantee the competition’s availability or its functioning. The competition may be lengthened, ended or removed without advance notification or explanation. Should this occur, participants will not be entitled to make claims against SVWW or any of its partners as a result.

SVWW reserves the right to exclude participants from participating in the draw. This is particularly applicable in cases where the conditions of participation are contravened or in cases of manipulation. 

7. Liability

The following exclusions of and limitations to SVWW’s liability for damages are valid without prejudice to any other statutory claims. SVWW shall not be liable for damages resulting from the malfunctioning of technical equipment, for delays in or disruptions to transmissions or for damages which arise in connection with participation in the competition or with the acceptance and/or use of the prize, except where SVWW has acted deliberately or with gross negligence. SVWW is freed from all obligations on delivery of the prize. No liability for any given prize’s quality will be accepted. Claims for liability against SVWW which arise from the use of the prize are expressly excluded. Furthermore, SVWW and/or associated companies shall not be liable for damages arising from impairments to the availability of the competition website in the case of technical disruptions over which no influence can be exerted, in cases of force majeure or in the case of disruptions caused by third parties. Nevertheless, SVWW will do everything in its power to ensure the reliability and functionality of the competition website. Moreover, SVWW provides no guarantee that the competition website will function properly on any individual participant’s computer.

8. Data Protection

The following data protection statement informs participants about the nature, scope and purpose of the collection and use of their data within the scope of the competition by SVWW as a responsible entity with regard to data protection law. 

SVWW collects personal data (name and mobile telephone number) when participants take part in the draw. The data provided by participants will only be used by SVWW for the purpose of notifying a participant that he or she has won. After the draw has been completed and the winner notified, these data will be deleted.

9. Miscellaneous

Should individual provisions contained within the conditions of participation be invalid or should provisions be incomplete, this shall not affect the validity of the remaining provisions. The invalid or incomplete provision shall be replaced or supplemented by such a provision which comes closest to the interests of the organiser and the parties involved.

SVWW reserves the right to adjust these conditions of participation, especially in cases of changed statutory or technical circumstances. The conditions can be viewed in their currently applicable version online.

The only applicable law for participants resident in Germany is that of the Federal Republic of Germany in conjunction with the regulations regarding conflict of laws.

Participants’ conditions that deviate from the above conditions will not be recognised unless the organiser explicitly consents to their validity in writing.

Recourse to legal measures is excluded.
